This Agreement sets forth the terms and conditions for your use of the DermaDonut® website ("Site") and any products, services, or information provided by DermaDonut® ("Services"). By accessing or using our Site or Services, you agree to be bound by this Agreement.

Use of Site and Services:

  4. Uploading or transmitting any harmful, offensive, or inappropriate content.
  5. Engaging in any fraudulent, misleading, or deceptive activities. 
  6. Impersonating any person or entity, or falsely representing your affiliation with any person or entity. 
  7. Accessing or using the Site or Services for any illegal or unauthorized purpose.

Intellectual Property:

2.1 Ownership: DermaDonut® retains all rights, title, and interest in and to the Site and Services, including all intellectual property rights associated with them. This Agreement does not grant you any right or license to use any trademarks, logos, or other proprietary materials of DermaDonut®.

2.2 User Content: By submitting or posting any content on our Site or through our Services, you grant DermaDonut® a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content. You represent and warrant that you have the necessary rights and permissions to grant this license.

  1. Disclaimer of Warranty:

DermaDonut® provides the Site and Services on an "as is" and "as available" basis. We do not make any warranties or representations, express or implied, regarding the Site or Services, including but not limited to their accuracy, reliability, completeness, or fitness for a particular purpose. You acknowledge and agree that your use of the Site and Services is at your own risk.

  1. Limitation of Liability:

To the maximum extent permitted by applicable law, DermaDonut® and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of the Site or Services.

  1. Indemnification:

You agree to indemnify and hold DermaDonut® and its affiliates, officers, directors, employees, agents, and licensors harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or Services or your breach of this Agreement.

  1. Termination:

DermaDonut® may terminate or suspend your access to the Site or Services at any time and for any reason without prior notice. Upon termination, your right to access or use the Site or Services will immediately cease, and you agree to cease all use of the Site and Services.

  1. Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of Las Vegas, Nevada, USA. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Las Vegas, Nevada, USA.

  1. Changes to this Agreement:

DermaDonut® reserves the right to modify or update this Agreement at any time. If we make any material changes, we will notify you by email or through a prominent notice on our Site. Your continued use of the Site or Services after such modifications shall constitute your consent to the updated Agreement.

  1. Entire Agreement:

This Agreement constitutes the entire agreement between you and DermaDonut® regarding the subject matter herein and supersedes all prior or contemporaneous understandings or agreements, whether oral or written.
